Archetype Strength - Open Gym - Paid in Full

GENERAL TERMS AND CONDITIONS 1-19

I, {first_name}, agree to the following terms and conditions of Archetype Strength.

The terms of your membership at Archetype Strength.

The terms of this membership can change with 60 day notice from Archetype Strength staff.

All private training sessions booked require 24 hour's notice from the member for cancelation to avoid penalty. If a session is cancelled with less than 24 hour's notice, the full amount of that session will be charged to the member.

Monthly memberships entitle the member to go to the gym at any time. Archetype Strength reserves the right to increase membership fees at any time with a 30 day notice. All membership fees will be paid automatically via bank transfer or credit/debit payment.

If you wish to cancel your gym membership, you are required to provide a final month's notice which is done on our website at www.archetypestrength.com/cancel. Upon submitting your cancellation request, your membership will remain active for one additional billing cycle. The following month after your cancellation notice will be your final month of membership, during which your regular membership fees will apply. After the completion of this final month, your membership will be terminated, and no further charges will be incurred.

There are no pauses on open gym memberships with Archetype Strength. 

There are no refunds for anything… EVER! (Unless we have made a billing error!). If you decide to chargeback a membership fee that was not in error and was decided upon in our favor, you will be issued a $25 fee per charge that was disputed.

Exceptions are at the sole discretion of the Archetype Strength owners.

Any member who demonstrates behavior that is in any way deemed by the owners to be destructive to the Archetype Strength community may have their membership terminated and contract rescinded without warning, and without refund. NO ASSHOLES ALLOWED!

If a member's account balance is not paid in full on the due billing date, the member will have 10 days to make their late payment in full. If the member has not paid their dues by the 10th day, a $10 charge may be added to the clients account. By the 10th day, access to the gym will be rescinded.

I understand if I have an unpaid balance to Archetype Strength and do not make satisfactory payment arrangements, my account may be placed with an external collection agency. I will be responsible for reimbursement of any fees from the collection agency, including all costs and expenses incurred collecting my account, and possibly including reasonable attorney's fees if so incurred during collection efforts.

In order for Archetype Strength or their designated external collection agency to service my account, and where not prohibited by applicable law, I agree that Archetype Strength and the designated external collection agency are authorized to (i) contact me by telephone at the telephone number(s) I am providing, including wireless telephone numbers, which could result in charges to me, (ii) contact me by sending text messages (message and data rates may apply) or emails, using any email address I provide and (iii) methods of contact may include using pre-recorded/artificial voice message and/or use of an automatic dialing device, as applicable.

All Archetype Strength members deserve an un-interrupted enjoyment experience. To protect this enjoyment we have a no solicitation policy to ensure our members are not being solicited products by other members. Archetype Strength is a no solicitation zone… We don't want anyone to feel pressure or weird about being pitched something in what should be his or her training sanctuary. But by all means if you have a product that you would like to discuss with Archetype Strength to see if it would be of interest for the gym please speak to one of the Archetype Strength staff.

The Archetype Strength team has worked extremely hard to provide the members the best training facility they can, and as a result we expect the members to treat the equipment with respect as well as the Coaching staff and all of the members. We understand that equipment has a natural life cycle, and will receive wear and tear over the course of being used, but abuse of the equipment (including but not limited to the terms outlined in the code of conduct section below) that causes damage to the equipment or the facility in any way will be assessed at replacement value and the cost passed onto the member who caused it. 

The following is a list of rules that we enforce at Archetype Strength:

Archetype Strength will often take photos and video of it's members during workouts or special events, and may choose to post the photos on the website or social media sites. The member agrees that his or her imagery and likeness are approved for Archetype Strength to use for any purpose pertaining to the general nature of the industry. There is no compensation for any imagery or likeness used in any form whether promotional or commercial.

Archetype Strength only offers the following discounts:

For every person you refer, you will receive 10% off your total bill.

Additional family members may receive a 50% discount, so long that they are on the SAME CREDIT CARD and live at the same address. The first family member will be full price.

There are no other discount options available.

I authorize Archetype Strength, to transfer electronic funds on a recurring basis from the checking, savings, or credit card account I specified above for my membership dues. This authorization is to remain effective until Archetype Strength has collected for all charges assessed in connection with the terms and conditions of this Agreement. Members must ALWAYS have a valid payment method on file at Archetype Strength to facilitate membership charges and applicable charges to the members account.

The members signature on this membership agreement allows Archetype Strength to charge the payment method (credit card or EFT submitted by the member) for any dues owed under this contract, and states that the member agrees to the terms and conditions of the membership. Members must abide by these terms and conditions which are displayed on the Archetype Strength website URL https://www.archetypestrength.com/terms . The terms and conditions may be updated from time to time and it is the responsibility of the member to stay up to date on the terms. The members signature on this membership agreement allows Archetype Strength to update the GENERAL TERMS AND CONDITIONS 1-18 of this agreement. You can bring a guest in to try the gym ONE TIME, after informing Archetype Strength staff about their visit. After that initial visit, the guest must purchase a membership.  You can bring other people in one time as well - they too may come in for a single unpaid visit.  After their visit, your guest is welcome to sign up for the gym, and per our referral policy, you will receive 10% off for every referral you make to the gym.

Do not bring anyone who is not a member of Archetype Strength Open Gym into the facility under any condition without first informing staff. If you bring any person to the gym who is not a member of Archetype Strength, you will be charged a $250 liability fee. If this happens twice, your membership will be immediately revoked.

I am participating in a program of physical activity, including, but not limited to, all of any of the following services and related activities offered by Archetype Strength LLC ("Archetype Strength"): 24 hour open gym, fitness classes, personal training sessions and nutritional programs, (together, the "Services"). I hereby assume all responsibility for my participation in the Services and acknowledge that: (a) I have had a physical examination and have been given my physician's permission to participate in the Services (or that I have decided to participate without the approval of my physician), (b) participating in the Services will involve strenuous activity, risk of injury and of death, whether caused by myself or someone else, and (c) I am voluntarily participating in the Services with the knowledge of the dangers involved, including, but not limited to, the potential for a heart attack, muscle strains, pulls or tears, broken bones, shin splints, heat exhaustion, knee injuries, lower back injuries and soreness however caused, and any physical or property damage or loss, occurring during or after my use of the Services.

IN CONSIDERATION OF ARCHETYPE STRENGTH ALLOWING MY PARTICIPATION, I HEREBY AGREE AS FOLLOWS:

This waiver and release shall (a) be governed by North Carolina law, and (b) be effective and binding upon my spouse, heirs, next of kin, relatives, executors, administrators, assigns and representatives in the event of my death or incapacity.

I have read to and agree with the above terms.

I understand that cancellation requires a final month notice inputted on our form at www.archetypestrength.com/cancel

I understand I may not bring guests without first asking, and guests are allowed to come one time for a free workout, after which they can join the gym as your referral.

I understand I have 24 hour access to the 3 most badass gyms in Raleigh!!!!
